Agreement

These Terms & Conditions are a legal agreement between you and Tyler Dennis (“we”, “us”, “our”) governing your use of the PitLane Pro website, applications, and services.

Acceptance

By accessing or using PitLane Pro, creating an account, or subscribing to a paid plan, you agree to be bound by these terms. If you do not agree, do not use the service.

Eligibility and authority

You must be at least 18 years old and, if using the service on behalf of a business, have authority to bind that business. You agree to provide accurate and complete information and keep it up to date.

Service description

PitLane Pro is a cloud-based shop management platform for auto repair businesses. It includes features such as repair orders, estimates, invoices, workflow boards, appointment calendars, customer and vehicle records, labor guides, VIN decoding, reporting, and customer communication tools. Features may change over time.

Account security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use.

Acceptable use

You agree not to misuse the service, including by:

• Using it for unlawful purposes or violating applicable laws.
• Engaging in fraud, spam, or deceptive practices.
• Infringing intellectual property or other rights.
• Interfering with security, introducing malware, probing networks, or scraping data without authorization.
• Attempting to access another user’s account or data without permission.

Intellectual property

PitLane Pro retains all rights, title, and interest in the service, including its software, design, branding, documentation, and content. We grant you a limited, non-exclusive, non-transferable right to use the service according to your subscription plan.

Restrictions

You may not:

• Reverse engineer, decompile, or disassemble any part of the service.
• Resell, redistribute, or sublicense access to the service.
• Circumvent usage limits, billing, or access controls.
• Use the service to build a competing product without authorization.

User content

You retain ownership of the data you enter. You grant us a limited license to host, process, and display that data solely to provide and improve the service. We will not use your customer data for unrelated purposes.

Service level

We aim to keep the service available and reliable, but we do not guarantee uninterrupted or error-free performance. Scheduled maintenance and unexpected outages may occur.

Payment and subscriptions

PitLane Pro is offered on a subscription basis with a free trial period. After the trial, your subscription renews monthly unless cancelled. Fees are charged in advance. Taxes, where applicable, are calculated at checkout.

Payment processing, billing, tax, subscription management, cancellations, and refunds are handled by our online reseller, Paddle.com. Paddle.com is the Merchant of Record for all our orders. Suspension and termination

We may suspend or terminate your access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. Upon termination, your right to use the service ceases immediately.

Warranties disclaimer

The service is provided “as is” and “as available” without warranties of any kind. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

Liability

To the extent permitted by law, our aggregate liability is limited to the fees you paid us in the twelve months preceding the claim. We are not liable for indirect, consequential, special, or punitive damages, including lost profits, data loss, or goodwill, except where liability cannot be excluded by law, such as fraud, death, or personal injury.

Indemnity

You agree to indemnify and hold harmless Tyler Dennis from claims arising out of your content, unlawful use of the service, or breach of these terms.

Consequences of termination

When your access ends, you may have a limited window to export your data. After that period, we may delete or anonymize your data in accordance with our Privacy Notice.

Governing law and disputes

These terms are governed by the laws of the jurisdiction in which Tyler Dennis is established, without regard to conflict of law principles. Disputes will be resolved in the courts of that jurisdiction.

Changes to these terms

We may update these Terms & Conditions from time to time. Continued use of the service after changes are posted constitutes acceptance of the revised terms.
